Acceptable Usage Policy
The Client acknowledges and agrees that the provision of Services to the Client by BlackHOST, and Client's acceptance and use of BlackHOST's Services, constitute BlackHOST's acceptance of and agreement to the terms and conditions of this document, BlackHOST's Acceptable Use Policy (“BlackHOST's AUP") and that BlackHOST's AUP is an integral part of, and is incorporated by reference into, the Terms Of Service ("TOS") Agreement by and between BlackHOST and the Client.
BlackHOST AUP covers the Client’s general use of the Services if not otherwise defined by Service Level Agreement. Doing, causing or allowing (whether by act or omission) any of the following, and/or any direct or indirect aiding or abetting of any person or entity to do, cause or allow (whether by act or omission) any of the following, is considered a
violation of BlackHOST's AUP and of the TOS Agreement between BlackHOST and the Client:

- 1.1 BackHOST as a hosting and service provider reserves the rights to refuse service to anyone.
- 1.2 Any material that in our judgment violates this AUP in any manner may be removed from our servers (or otherwise disabled), with or without notice.
- 1.3 BlackHOST reserves the right to decide whether to contact the Client to inform regards violation in BlackHOST’s AUP
- 1.4 This AUP, may be modified from time-to-time at our sole discretion and at any time without prior notice to the Client. The Client agree to be bound by these modifications. The most recent version of this AUP can always be found here.
- 1.5 Client’s failure to respond to an email from BlackHOST abuse department within the specified time period in our email to you may result in the suspension or termination of the Client services.

- 2.1 Illegal Activities: Using BlackHOST's services for illegal purposes or in support of illegal activities, including, but not limited to, transmitting (by email, uploading, posting or otherwise) or distributing, downloading, copying, caching, hosting or storing data, information or content which, in BlackHOST's sole determination, constitutes a violation of any relevant law, regulation, ordinance or court order. The Client shall be responsible for determining what laws, regulations, ordinances and court orders are applicable to its use of BlackHOST's services
- 2.2 Threats: Using BlackHOST's services to transmit (by email, uploading, posting or otherwise), distribute, download, copy, cache, host or store on a server any material that threatens or encourages bodily harm, destruction of property or any other type of harm
- 2.3 Harassment: Using BlackHOST's services to transmit (by email, uploading, posting or otherwise), distribute, download, copy, cache, host or store on a server any material that harasses or stalks another
- 2.4 Harmful: Using BlackHOST's services to transmit (by email, uploading, posting or otherwise), distribute, download, copy, cache, host or store on a server any material that is harmful, abusive, defamatory or libelous
- 2.5 Copyrighted Content: use of the Services for hosting copyrighted content is governed by General Copyright Policy which can be found here.

- 3.1 Any content that, in our judgment, is unethical, obscene, threatening, harmful or illegal violates our Terms of Service or this AUP, this includes but not limited to the following type of content
- Botnet controllers / clients
- Bruteforce Programs / Scripts / Applications
- Hacker focused sites / archives / programs
- IP Scanners
- DDoS tools
- SItes promoting illegal activities
- Proxy Scripts / Anonymized
- Fraudulent / Phishing Sites
- Push button mail scripts
- Mail Bombers / Spam Scripts
- Spoofing / Impersonation
- 3.2 Using BlackHOST services to harm minors in any way or transmitting (by email, uploading, posting or otherwise), distributing, downloading, copying, caching, hosting or storing on a server any child pornography as defined in accordance with Article 34 of the United Nations Convention on the Rights of the Child.
- 3.3 Using BlackHOST services to provide support or resources (including concealing or disguising the nature, location, source, or ownership of support or resources) to any organization designated by the U.S. government as a terrorist organization in accordance with section 219 of the Immigration and Nationality Act (INA)SPAM POLICY ( Zero Spam Tolerance )

- 4.1 The Client must comply with the CAN-SPAM Act of 2003 and all relevant regulations and legislation on bulk and commercial email.
- 4.2 BlackHOST do not tolerate sending mass unsolicited email messages.
- 4.3 All emails sent to recipients who have not Confirmed Opt-In or Closed-Loop Opt-In in to mailings from the Client will be considered as unsolicited email messages / SPAM.
- 4.4 BlackHOST closely monitors all publicly known spamming blacklists, if your service public IP is listed on one or multiple blacklists BlackHOST may undertake the following measures:
- Account suspension
- Termination of services

- 5.1 BlackHOST network is designed to meet the anticipated needs of its clients, customers, users, and our needs. If BlackHOST determine that Client use of BlackHOST network impairs the stability of BlackHOST network, BlackHOST may suspend or / and terminate Client account / service.

- 6.1 While BlackHOST encourages all Clients to contact our support department for any kind of issues or questions that they want to see resolved / answered, opening multiple tickets on same subject is stressing out BlackHOST support department and it will be considered as support overusage.
- 6.2 If support over-usage is detected BlackHOST keeps the right to merge and de-prioritize Client ticket and put it on the bottom of its support queue.
- 6.3 Rising multiple subjects addressing different issues on a same ticket can also may result with slower ticket / issue resolving.
